"Yes. He robbed me. Took my wallet."

"He took your wallet, Mr. Anderson? You mean, surely, that he tore your pants off and physically removed your wallet with his own hands?"

"Well no, it wasn't quite like that..."

"Well what was it like, Mr. Anderson?"

"He told me to give him his wallet and threatened me."

"And did you hand over your wallet, Mr. Anderson?"

"Well... well yes I did."

"So you willingly removed your own wallet and transferred possession of said wallet to the defendant?"

"No, he robbed me! He said he had a gun!"

"Did he, Mr. Anderson? Did he really say that?"

"Yes!"

"My client denies any such thing. What do you have to say?"

"He said he had a gun, and to give him his wallet."

"And did the defendant touch or harm you in any way?"

"Well... no... nothing happened like that... I was afraid!"

"Did you tell him that?"

"What? No! What kind of question is that?"

"So here we are left to believe only your word, Mr. Anderson? Your word that you freely handed over your wallet to the defendant, with no signs of violence, no evidence of any untoward actions, and yet you insist on wasting our time with this?"

"I was robbed!"

"That is precisely the issue under question, Mr. Anderson. Simply repeating yourself doesn't help. Mr. Anderson... were you drinking on the night of 14 December 2010?"

"Well yes... I was coming home from a pub I was at with my friends."

"Really, Mr. Anderson. How much did you drink?"

"Well I don't know really... a few beers, a couple shots... there was a birthday..."

"Ah, so it would be safe to say that you were suffering from, let us say, impaired faculties?"

"I know what happened to me!"

"Do you, Mr. Anderson? I can have an expert testify before the court that even moderate alcohol consumption greatly affects memory."

I sympathise with what you are trying to say, and I think you have some good points wrapped up in there.

But as a tool for changing the mindset of those who see the issue differently, I think your analogy of robbery and rape contains enough discrepancies that it can only serve to sings to the choir.

The issue isn't one of discrepency. Criminal actions have a similar logical "provability". You have to prove a crime took place and that the person charged commited it.

If he kept it to the silliness of tactics used to argue before juries then he'd have made a better point. But the capper of conservatives dismissing rape accusations poisoned it.

seriously , this was done as a satire/comedy sketch on UK TV, except the guy walks into a ploice station and the desk sergeant takes the same line, and tries to pin it on the victim that it was his fault that his wallet got taken from him, but no mention of any court at the end. I saw it when I was - oh , about 25, I would say.

It is that old, nothing new. A sad reflection on society that the problem is still with us, and the story line has not chaged much. How we go about changing the mindset of the perpetrators is beyond me, but the problem is that statistically, a woman is most unlikely to be raped by a stranger who breaks into her home or leaps out of the bushes.

A far more likely scenario is that a woman knows the man involved, that he is someone who has known her for some time and would not dream of physically attacking a woman or holding a gun to her head.

However, he is the sort of guy who is not above pressuring her to ' have another drink', or trying to ' work up a "yes" situation' by being coercive or manipulative. he might even think that he is 'entitled' to something because he took her out to dinner.

The bottom line is, though, that if a man can't take 'no' for an answer, he's a self centred jerk and nothing more. And it seems to me that no matter how much we go into classes and colleges and talk to young men, or put ads on condom machines telling guys that getting consent is important, there still does not seem to be any shortage of guyscoming forward to prove that they are self centred jerks.

Yes, everything you say is true. The problem is that using the vision of rape presented in the OP 95% of the males and probably around 80% of the females in the human race are guilty of rape.

Yes, No means No. But it does not mean stop asking and I am sorry but manipulative behavior to turn a no into a yes get it is simple boorish behavior, not rape.

Even coercion is not always rape, as long as the coercion does not involve threat of violence. Telling someone "sleep with me or I'll leave you" is mind numbingly stupid and selfish, but if they agree they have still consented, even if they feel sick about it after the fact.

I take it from your last line that you think conservatives don't take rape seriously as a crime. Why do you believe this? I am conservative, and I certainly don't blame the victims of rape.

Is it because of the "forcible" rape brouhaha? Because it's my understanding that was just an attempt to separate the statutory cases from the ones where the victim was truly unwilling.

I'm not trying to engage in wank here. I am really interested in references to conservative policies or leaders who advocate blaming the victim in rape cases. Because I don't know anyone who thinks like this except a few ignorant lowlifes who need to be bitchslapped.

It is sad how often the victims of rape are blamed for their assault. I remember reading a case once where a victim was wearing tights jeans, so she couldn't possibly have been raped as the rapist wouldn't have been able to rip them off. Very disturbing.

Though, I would have to say it's not only in a conservative court, but almost all courts these days. :(
