Second amendment rights. But only for Christians and McCain voters.

This is really dumb, and I'd like to see everyone in this comm agree that the owner of this store is violating the law and discriminating unjustly. That is my view, if there is another view out there, please, share it with me.

I recall disagreeing with the argument that state's rights trumped individual constitutional rights which the 14th amendment applied consistently across all levels of government. (As I think of it, I can recall specifically stating how I diverged from Goldwater on the states' rights argument).

^This cannot be squared with this:

nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

So you're telling me you cannot square the position that:

States' Rights arguments do not apply when constitutionally protected rights are at stake...

with:

Equal protection of the law.

I'm sorry, the mind is boggling, because you're usually the one who has a bitter reaction when someone mentions states' rights in a positive bent and in this case I'm on your side, and presumably you're not against the fourteenth's guarantee of equal protection either, so... either I'm missing something or there's a lack of real communication going on.

Given that I've a lot of respect for you as both a person and a debater I'll give you the benefit of the doubt and go with a lack of real communication. I think the question to me is how the idea that refusing to patronize racist establishments would have actually toppled the system when it was enforced. Especially since in segregation days there were absolutely no integrated establishments, and anyone white who would have tried would have failed had someone attempted to set one up. The KKK didn't just target blacks when it came to shoring up segregation, and the KKK has been illegal since the 1870s.....

Perhaps that's where the miscommunication is. I'm thinking of separate-but-equal laws, which was finally ruled as anything but equal (the only sane way to understand it for what it is in my opinion, and the reason why the fourteenth justly could be exercised by the federal level).

In any case, I think I'm going to hang it up in the spirit of putting this whole post behind me, hoping that others do so as well.
