You can listen to the call placed by Whalen. She never mentions "Two black men" instead she says "one man who might be Hispanic." She also is uncertain that it is even a break in. In addition, she says she never spoke to Sgt. James Crowley! But, Sgt. James Crowley, says that he did speak to her in his police report (upon arriving at the scene) and he claims she is the one who told him it was 2 black men with backpacks.

Hence, the police report contains factual errors.

Before the 911 call was released Gates said the flowing:

O'BRIEN: A neighbor called 911. I mean, it was a neighbor of yours who said that description, two black men breaking into your house. Are you angry with your neighbor?

GATES: No. In fact I hope right now that if someone is breaking into my house this nice lady is calling the police. I have a lot of valuable art and books in that house. And in fact, I think I'm going to send this
person some flowers. I hope she is watching. I know that she must be intimidated and she must think that I'm very angry.

It wasn't her fault. It was the fault of the policeman who couldn't understand a black man standing up for his rights right in his space. And that's what I did. And I would do the same thing exactly again. (source)

Will, Crowley also apologize to Whalen for the errors in his police report that lead some people to think she was racist? Why did Crowley claim that he spoke to Whalen when she says this did not happen. Why did Crowley claim that Whalen said she saw "two black men with backpacks" when she never said any such thing?

There is a conflict between two personal statements. You've chosen which one to call "the" truth.

Also, you owe Crowley another apology for claiming that he lied about speaking to Whalen. As this less hysterical report (http://news.yahoo.com/s/ap/us_harvard_scholar_caller) makes clear, she didn't claim to not speak to the officer, she is claiming she never said anything about race to him.

And Crowley isn't the one who took the 911 call. Why are you attempting to change the subject?

911 is every policeman cell number, when you call 911 the officer closest to you picks up the horn, asks all the info and goes to the site of incident, if they need ambulance and fire they SMS them, duh!

She claimed that two men, one hispanic, was trying to get into a house when it was one black male. As a witness, her testimony would be thrown out of any court, and that means her testimony has no credibility.

I'm not passing any sort of judgment on her personality, but her testimony in this matter does not have credibility.

The attorney's stance on Whalen's behalf is significantly colored by this: Speaking to CNN by phone, Murphy said she was trying to clear Whalen's name after she's come under attack by bloggers and in chat rooms, accused of racial profiling when she first called police.

"The attorney's stance" can't "color" the 911 recording. Or the recording of what the dispatcher said to Crowley.

The recording is irrelevant. The police report only refers to Crowley talking to Whalen AFTER the incident (which is normal) and that is what the attorney is disagreeing with. Knowing police procedure, I doubt the attorney is being accurate.

Crowley is looking better as time goes on and Gates looks like an overreacting ass so a full press is needed to salvage it.
