Of course it is. This is why we got those regulations - the big companies knew that their smaller competitors couldn't adapt. All regulation throughout history has that same result.
I don't see the downside. If a company can't make a food that won't poison you, I don't really have any sympathy.
Large companies already meet the standard, thus they're exempt, and the smaller companies are forced to get the testing for the toys. Oh, and the large companies own the only places that can do the necessary testing, so the smaller toy companies have to pay the larger ones just for the right to sell.
Please stick to food regulation. Also note that in food regulation you're never 'exempt' from testing.
