It may not be, but at least in its current form it is perfectly constitutional law.

It passed 'muster'.

Nothing fancy, just a question. Or three

How does the SCOTUS decision upholding the reforms now known fondly as ObamaCare play into the political fight?

Is this a political victory or just another 'reason' to elect the Mittens "I'll dismantle ObmamaCare and replace it with RomneyDon'tCare"

Me? I think it's kind of cool and a step toward a Star Trek™ Universe. As a small business person, I can use the tax credits and we REALLY want to provide affordable health care to our staff and managers. I"m surprised, but not disappointed. This system is fucked. ObamaCare is a good start.

So-called Obamacare was really the conservatives' compromise position on universal healthcare, until they decided that maybe they didn't need to compromise at all. I was kind of hoping the conservatives on the Court might overreach and nullify the law, and then we might be able to go for single-payer.

I'll just repeat myself.

Headline: OBAMA IMPOSES HUGE TAX INCREASE ON STRUGGLING AMERICANS. -SCOTUS

And then expand.

By upholding the ACA under the taxing power of Congress and rejecting the Commerce Clause argument, SCOTUS does two things to the Obama campaign.

1. It makes Obama look deceitful. For the entire debate he was adamant. ADAMANT. The ACA was not in anyway a tax. He derided Republicans for claiming it was a tax. He went so far as to belittle poor George Stephanopolis for trying to argue it was a tax. Then, when he got to the Supreme Court, his strategy was to say, Why you bugging about the scope of the Fed being expanded without any limits? Its is just another tax!

2. It makes it clear that the entire argument about how this was working with the private sector and how the goal was to promote savings and "bend the cost curve downward," was just empty rhetoric. This is a tax meant to fatten the government coffers and then redistribute the money to those bureaucrats decide are worthy. The only virtue this has is that means they can't actually force me to buy broccoli, but they can tax me for the privilege of preferring green beans.

Which to put it bluntly is no different than taxing pacifists to pay for the Iraq and Afghanistan Wars in terms of the government forcing people to do things they disagree with. But you never see arguments from pacifists that they should be entitled to one set of legal standards while everyone else is entitled to another.
