To some extent EU standardisation has led to cartel-like behaviour. Of course they are going to get together and talk about how to best deal with the standards the EU imposes, they are the largest quality car manufacturing industries in the world. And if there is a legitimate "cheat" the duty of a limited company to its shareholders is to maximise profit: so if you like, the fault is within capitalism without sensible oversight and restrictions. Which aren't just emissions, but include a duty to the spirit of the law before the duty to maximise profit and dividends.
